Stinson LLP Partner Mark Bell authored an article for Colorado Real Estate Journal examining how commercial real estate lenders and borrowers are navigating ongoing market stress through disciplined restructuring strategies rather than widespread enforcement actions.

In the article, Bell analyzes recent data showing increased loan modifications across the commercial real estate sector, including term extensions and payment restructurings, as lenders work to reposition viable assets amid elevated vacancy rates, rising interest costs, and significant debt maturities. He explains how this shift reflects a broader move away from crisis-driven responses toward gradual stabilization.

The article also highlights alternative strategies such as preferred equity investments, mezzanine financing, joint-venture recapitalizations and loan participation sales, which can provide flexibility and liquidity while maintaining loan relationships. Bell observes that these approaches are particularly relevant in office markets, including Denver, where stress persists alongside stronger performance sectors such as multifamily and industrial.

He concludes that while certain assets will continue to face challenges, measured restructuring and strategic discipline are likely to define the commercial real estate market in 2026, creating opportunities for borrowers, lenders and investors willing to adapt to evolving conditions.

Bell's practice is focused on representing banks and other financial institutions in both litigation and corporate transactional matters. He also frequently handles complex real estate and commercial matters, bankruptcy, restructuring and creditors' rights, and general corporate litigation in state and federal courts nationwide.
