Overview
Daniel is a dedicated advocate who leverages his analytical skills and diverse legal experience to help employers reach forward-looking, business-centric solutions to an ever-evolving employment landscape.
Daniel’s practice relies on his technical legal background to assist clients in navigating the complex labor and employment landscape, including wage and hour disputes, discrimination and retaliation claims, non-compete and confidentiality agreements, and labor disputes.
Daniel has defended and advised clients wage and hour disputes arising under the FLSA and state wage and hour analogues. Recently, he assisted in defending against an FLSA collective action lawsuit which sought more than $60,000,000 in back wages and liquidated damages. Daniel helped the client resolve the lawsuit on an individual basis for nuisance value. Daniel also advised clients on compliance related wage and hour issues, such as bonus structures, compensability of pre-shift activities, and employee classification.
Daniel also has experience defending discrimination and retaliation claims arising under Title VII, ADA, FMLA, PWFA and ADEA. He draws on his experience as an extern for the Honorable Administrative Judge Weinhaus at the EEOC to help clients navigate these claims from the administrative proceeding stage through litigation. Recently, Daniel helped secure summary judgment for a client on all three ADA claims brought by a former employee. He has also advised clients on accommodation policies, FMLA compliance, and human resource disciplinary issues.
Daniel’s practice also involves advising, drafting, and enforcing restrictive employment covenants such as non-compete, non-solicit, and non-disclosure agreements. Restrictive employment covenants require a practical and “facts on the ground” approach, and Daniel helps clients reach the solution necessary to achieve their goals. Similarly, Daniel has advised clients of creative and pragmatic solutions to ensure production continues despite ongoing labor disputes. This variety of experience helps him quickly identify, understand and address a business’s unique personnel needs.
Daniel’s practice draws on his ability to research, analyze complex legal issues, and draft persuasive briefs he gained through a clerkship with the Colorado Court of Appeals.
